Welcome to CollectiveOasis ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at collectiveoasis.sbs (the "Service") operated by CollectiveOasis.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
CollectiveOasis offers luxury yacht charter services, which include among others:
- Day charters
- Evening sails
- Business retreats
- Exclusive gatherings
- Long-term charters
Service availability is dependent on numerous factors and we may adjust or cease offerings as seen fit.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, certain requirements must be met:
- Minimum age of 18 years
- Furnishing accurate and complete details
- A prepayment in line with the outlined amount on your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed once payment is made and acknowledged by us in writing. We have full discretion in choosing our clientele.
3.3 Availability
Charter services are based on the availability of vessels and favorable weather conditions. Efforts to accommodate preferences regarding dates and times will be made wherever possible.
4. Payment Terms
4.1 Pricing
All fees are stated in € and are inclusive of taxes unless specified otherwise. Note that prices are subject to change.
4.2 Payment Schedule
- Deposit: 50% of total cost required at the point of booking
- Final Payment: To be settled 48 hours before set sail
- Incidental charges (if any): Payable upon completion of the service
4.3 Payment Methods
We accept a variety of payment methods including major credit cards, direct bank payments, and certified cheques, ensuring secure and encrypted financial transactions.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours in advance of departure: Full reimbursement minus transaction costs
- 24-72 hours prior to departure: Partial reimbursement of 50%
- Within 24 hours of departure: No reimbursement
5.2 Weather Cancellations
Should our captain deem weather conditions as precarious, accommodations will be made to:
- Reschedule to an alternate available date without additional charges
- Provide a full refund if an alternative date cannot be scheduled
5.3 Mechanical Issues
If your booked vessel encounters technical issues, we will endeavour to supply a comparable alternative. If this proves impossible, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Comply with all instructions given by the crew
- Utilize safety equipment when required
- Disclose any medical conditions that could affect their well-being
- Stay within authorized areas aboard the craft
6.2 Prohibited Items
Items not permitted on board include:
- Glass materials
- Illegal substances
- Guns or any forms of weapons
- Excessive amounts of non-alcoholic drinks (beyond moderate consumption)
- Animals (unless approval has been granted prior)
6.3 Conduct
Passengers must behave respectfully. We reserve the right to revoke the charter without reimbursement if behavior of those on board endangers safety or detracts from the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We are only liable up to the amount you have paid for the charter. We are not accountable for:
- Physical harm originating from your own actions
- The misplacement or destruction of personal items
- Any indirect, consequential, or significant monetary penalties
- Delays caused by weather or factors out of our purview
7.2 Insurance Coverage
Our vessels and operations are covered by holistic marine insurance. Passengers are advised to secure their own travel and personal insurance policies.
7.3 Assumption of Risk
In electing to engage in our charter services, you acknowledge the innate risks involved in sailing and take on the obligation for your personal safety.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or timetables due to factors like the weather, safety concerns, or operational necessities. We will do our utmost to offer equivalent alternatives should changes arise.
9. Force Majeure
We shall not be held accountable for holdups, cancellations, or service adjustments that result from unforeseen and unavoidable external situations including but not confined to:
- Extreme weather patterns
- Natural calamities
- Governmental directives
- Port suspensions
- Machine malfunctions
10. Privacy and Data Protection
We handle your confidential details in compliance with our Privacy Policy. Utilizing our services implies consent to our methods of collecting and utilizing your data as mentioned in our Privacy Policy.
11. Intellectual Property
All material on our site, from text and illustrations to logos and photographs, is safeguarded by copyright and trademark statutes. Reproduction, distribution, or the creation of derivatives is strictly disallowed without our express consent.
12. Governing Law
These Terms are under the jurisdiction of the laws in France. Legal disagreements will be settled in the courts situated in Cannes, France.
13. Changes to Terms
We reserve the prerogative to amend these Terms whenever deemed necessary. Updates will be communicated on our website with a corresponding revision date. Continuous utilization of our services symbolizes assent to the revised terms.
